"DRIVING LESSON"

Is an agreed period of time for theoretical discussion/consolidation and practice (Usually sixty minutes in duration), conducted on a specific day and time, agreed by both parties, where an agenda is agreed and set for both theoretical discussion usually followed by practical application.

We give no guarantees as to the total number of miles covered during a driving lesson but can confirm that an average of fifteen (15) miles per lesson is usually covered. We give no guarantees as to the length of time the tuition vehicles wheels are in motion for during the driving lesson.

Periodic breaks/stops during the driving lesson are to be anticipated for incidentals such as natural breaks required by both parties, vehicle refuelling, 'Show Me, Tell Me' practice. Any incidental breaks/stops irrespective of its nature or reason is deemed part of the driving lesson and is not then added to the remaining driving lesson time.

We operate a NO SMOKING POLICY inside the vehicle. Clients may request a smoking break, however, the time taken to smoke would of course be deducted from the lesson time. Smoking would take place outside of the tuition vehicle in a safe and convenient place.

11. You (not the Driving Standards Agency (DSA) examiner) are responsible for the tuition vehicle, whilst you are undertaking your practical driving test. The DSA examiner during test conditions, is an appointed professional observer, and is not performing his/her duties as a professional supervisor. In the interests of public safety, the DSA examiner, reserves the right to exercise a duty of care and assume control of the vehicle through the use of the dual foot controls and/or assistance on the steering wheel, should he/she feel that you are not entirely in control of the vehicle or the prevailing circumstances.

In the unlikely event of a road traffic collision caused by you, resulting in damage to the tuition vehicle, other vehicles, public/private property or a personal injury claim made against you by the DSA Examiner or another member of the public for your conduct whilst under test conditions, you will be liable for any insurance excess due (up to £150.00).

This also includes any incidental damage.

A pre-inspection of the tuition vehicles overall condition will be made upon arrival at the agreed collection point for the test appointment (Usually your fixed home address), prior to you taking responsibility of the tuition vehicle enroute to the driving test centre. An inspection report will be signed by you to confirm its overall condition prior to you driving the tuition vehicle to the test appointment.

We reserve the right to request a holding deposit payable on the day of your driving test to the value of the maximum excess amount (£150.00). This amount would be in addition to clause 9. of our terms of business.

12. There is a £30 charge for any returned unpaid cheques.

13. We reserve the right to change your tuition vehicle (Car) at any time.

14. Whilst every care is taken to ensure that you receive tuition at the agreed scheduled time and in the car booked, all appointments are made, on the understanding that we accept no responsibility for late arrival (Due to numerous factors usually beyond our control), the postponement of driving lessons, and practical tests due to mechanical breakdowns/instructor illness or any other reason. If you cannot be accommodated in another car, a fresh appointment will be made as early as possible. Neither are we responsible for driving test appointments postponed by the DSA.

Both pupil and Instructor will check that all bulbs required for the “show me tell me” questions are working correctly. Should a bulb blow on the day of the test, every endeavour will be made by the Instructor to replace the bulb in good time, in the event of replacement being unsuccessful we accept no responsibility or liability for any test fee lost as a result.

15. On the occasional driving lesson, there may be another instructor or DSA official observing us and not you. This is done for continued professional development, quality and assessment purposes.

16. You are asked to treat your Instructor/trainer/DSA Official and the tuition vehicle with the utmost of respect. Anyone behaving in an abusive or threatening manner, or using inappropriate language, will have their driving lesson/test terminated immediately and will be asked to alight the vehicle. Arrangements for getting home will be your responsibility. Payment for the lesson in full will be required.

All future lessons will be postponed pending an investigation. Any future lessons booked into the diary that fall short of the cancellation notice period will be charged for. Any further lessons booked into the diary that fall outside of the cancellation notice period will not be conducted until the matter resolved. If the matter cannot be resolved, then any remaining lessons that have already been paid for as part of a block booking will be reimbursed. An administration charge of £20.00 will be deducted from the balance remaining.
